Explanation of Certification Process

Any employee at Optimum Mechanical working as a sheet metal worker has an opportunity, with the expiry of the Collective Agreement between CLAC and Optimum, to choose to be represented by another Union.
Sheet Metal Workers Local 47 has been approached by employees of Optimum who are unhappy with the representation they are receiving from CLAC.

Outlined below is the process involved with the Ontario Labour Relations Board.

To begin the process, employees will sign membership cards with Sheet Metal Workers Local 47 in support of our Application to replace CLAC as the representative of employees. Those membership cards are confidential, and will be filed with the Ontario Labour Relations Board. No-one who signs a card will have that fact disclosed to the Employer, to CLAC or to any of their fellow employees.

Once Sheet Metal Workers Local 47 has signed membership cards for at least 40 % of the sheet metal employees of the Employer, Local 47 will make an Application for Certification to the Ontario Labour Relations Board.
Once that Application is filed, the Labour Relations Board will order that a vote of all sheet metal employees of Optimum be taken.

That vote will occur five (5) days (excluding weekends) after the Application for Certification is filed.

All sheet metal Employees will be given a choice of whether they wish to continue to be represented by CLAC, or represented by Sheet Metal Local 47.

If a majority of those casting a ballot in the representation vote choose to be represented by Sheet Metal Local 47, Local 47 will be certified by the Ontario Labour Relations Board as the representative of employees.
As a result of the fact that Local 47 negotiates a provincial collective agreement for the industrial, commercial and institutional (ICI) sector of the construction industry, and an Ottawa area residential sector collective agreement, any employers who are certified are bound immediately to those agreements.

Put another way, if employees of Optimum vote to be represented by Sheet Metal Local 47, the terms of the ICI Sheet Metal Agreement, and the Ottawa High Rise Residential Agreement will apply immediately.
